Medical Malpractice Survivors Urge President Obama To Keep 'Tort Reform' Out Of Health Insurance Bill

A group of medical malpractice survivors, many with family members who have died or were severely injured as a result of medical negligence, today sent letters to President Obama and the Congressional leadership urging them to keep additional "tort reforms" out of the health insurance reform bill. They said that responding to pressure from the insurance and medical lobbies to limit patients' legal rights would be a "tragic mistake."

The House and Senate health care bills already have provisions that support state efforts to explore litigation alternatives. So far, both the President and the Congressional leadership have opposed severe restrictions on patients' legal rights, such a "caps" on compensation, which Congress voted down at least five times during the Bush Administration. The Congressional Budget Office has said that even the most brutal restrictions on injured patients would save less than 1 percent of total health care costs.

The letter concludes, "Medical malpractice has taken a huge toll on all of our lives, as it has on the hundreds of thousands killed or injured each year due to preventable medical errors. Please continue to explore ways to improve patient safety and reduce unnecessary deaths, not diminish accountability for wrongdoers, limit our right to have cases heard before judges and juries, and burden taxpayers with the bill."

I am afraid I have to agree with no tort reform. An aunt who I love very much lost her husband to a grievous medical error that could have been prevented. He was the love of her life. Maybe what the insurance conglomerates do with all this money collected from physicians and other healthcare workers is where we need to start...All that money in their greedy hands---give me a break...

Total BS and typical liberal crapola. Over 90% of medical lawsuits are dismissed out of hand. People are going to have to decide one thing. Do we want medical care or do we want lawyers. We're now approaching one lawyer for every 200 persons. If we hung them all today, they'll be lawsuits from hell tomorrow.

    "IF" 90% of of medical lawsuits are dismissed "out of hand" doesn't that tell you that the system IS working? Plaintiffs' attorneys that take a case that gets dismissed lose ALOT of their OWN MONEY! The Bad cases get weeded out and the attorneys that are taking those cases go out of business. No one is standing at the courthouse handing out money for bad cases, defense attorneys are there to protect their client's money (Insurance Co.). The system works!

        Not at all. What I'm saying is that trial lawyers are scum and will eventually be eliminated one way or another.

          For the most part it is the insurance company's that would have to pay because of malpractice insurance the doctors have to carry so the repugs are only worried about insurance company's once again.

            Wrong Billie. What you're going to be left with is foreign nationals practicing medicine in this country. Trial lawyers are scum who need to be done away with. They are locusts who destroy while lining their pockets. The sooner we get rid of them the better.
